Terms of Sale

1. Purpose

These Terms of Sale govern transactions made on the MySquad platform between users and partner studios.

Important: MySquad acts as a payment intermediary and connection facilitator. The service contract is concluded directly between the user and the partner studio.

2. Pricing

2.1 Class Prices

Class prices are set by partner studios and displayed in euros including all taxes on the platform. They include all applicable taxes in France.

2.2 Service Fees

MySquad may charge service fees on each booking. These fees cover platform operating costs, customer service, and payment processing.

The service fee amount is clearly indicated before booking confirmation.

2.3 Price Changes

Partner studios may change their prices at any time. Changes only apply to new bookings and do not affect already confirmed bookings.

3. Order and Payment

3.1 Order Process

To make a booking:

  1. Select your desired class
  2. Verify the information (date, time, location, price)
  3. Create an account or log in
  4. Confirm your booking and proceed to payment
  5. Receive a confirmation email

3.2 Payment Methods

Payments are securely processed by Stripe. We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Other payment methods available through Stripe

3.3 Payment Security

All transactions are secured by Stripe, a PCI-DSS Level 1 certified payment provider (the highest level of security). MySquad never stores your complete banking information.

3.4 Payment Confirmation

Upon receipt of payment, you will receive a confirmation email containing your booking details. This confirmation serves as proof of purchase.

4. Cancellation and Refund

4.1 Cancellation by User

Cancellation policies vary by partner studio. Specific conditions are indicated on each class page and in your confirmation email.

General cancellation rules:

  • More than 24 hours before class: Full refund (excluding non-refundable service fees)
  • Less than 24 hours before class: No refund (except in case of force majeure)
  • No-show: No refund

Note: MySquad service fees (if applicable) are non-refundable.

4.2 Cancellation Procedure

To cancel a booking:

  1. Log in to your MySquad account
  2. Go to "My Bookings" section
  3. Select the booking to cancel
  4. Click "Cancel Booking"
  5. Confirm the cancellation

You will receive a cancellation confirmation email. If a refund is applicable, it will be processed within 5 to 10 business days.

4.3 Cancellation by Partner Studio

If a partner studio cancels a class for reasons beyond their control (instructor illness, technical issues, etc.), you will receive a full refund, including service fees.

The partner studio or MySquad will notify you by email as soon as possible and will offer, if available:

  • Rescheduling to another time slot
  • Full refund

4.4 Force Majeure

In case of force majeure (natural disaster, pandemic, government decision, etc.) preventing the class from taking place, refunds will be processed according to applicable regulations.

5. Right of Withdrawal

5.1 Exclusion of Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to services fully performed before the end of the withdrawal period and whose execution began with the consumer's prior express consent.

By confirming your booking, you expressly agree that the service begins before the end of the 14-day withdrawal period and waive your right of withdrawal.

5.2 Alternative to Right of Withdrawal

Instead of the right of withdrawal, you benefit from the cancellation policy described in Article 4.1.

6. Disputes and Complaints

6.1 Complaints About a Class

If you encounter a problem with a class (quality, safety, instructor, etc.), you must first contact the relevant partner studio directly.

If the problem persists, you can contact our customer service at contact@mysquad.me. We will do our best to facilitate an amicable resolution, but MySquad is not a party to the service contract and is not responsible for services provided by studios.

6.2 Complaints About Payment

For any complaint regarding payment or refund, contact our customer service at contact@mysquad.me with your booking number and complaint details.

We will process your request within a maximum of 10 business days.

6.3 Intermediary Status and Disputes

MySquad acts as a technical and payment intermediary. Sports services are provided exclusively by partner studios, who are solely responsible for their execution.

Consequently:

  • Any dispute relating to a sports service (class quality, safety, instructor, etc.) must be addressed directly to the relevant partner studio.
  • The partner studio is required to offer its clients a consumer mediation system in accordance with applicable regulations.
  • MySquad may facilitate contact between the user and the studio, but is not a party to the sports service contract.

7. Liability

7.1 MySquad's Liability

MySquad is only responsible for the proper functioning of the platform and secure payment processing. MySquad is not responsible for:

  • The quality of classes provided by partner studios
  • Injuries or accidents occurring during classes
  • Cancellations or changes to classes by partner studios
  • The behavior of instructors or other participants
  • Compliance of studio facilities with safety standards

7.2 Partner Studio Liability

Partner studios are solely responsible for the services they provide, the safety of their facilities, the qualifications of their instructors, and their professional insurance.

7.3 User Liability

The user is responsible for:

  • The accuracy of information provided during booking
  • Their medical fitness to practice the booked activity
  • Compliance with safety instructions given by the partner studio
  • Their behavior during the class

8. Invoicing

An electronic invoice is available in your personal space after each booking. This invoice serves as a receipt for your payment.

The invoice includes:

  • The class price
  • MySquad service fees (if applicable)
  • Total amount including taxes
  • Partner studio information

9. Data Protection

Personal data collected during your order is necessary for processing your booking and complying with our legal obligations.

10. Applicable Law

These Terms of Sale are governed by French law. In case of dispute, and failing amicable agreement or mediation, the dispute will be brought before the competent French courts.

11. Modifications to Terms

MySquad reserves the right to modify these Terms of Sale at any time. The applicable Terms are those in effect at the time of your order confirmation.
